Welcome to Iris Delany Photography + Graphic Design, a professional photography and graphic design service. By booking any services with us, you agree to the following terms and conditions. Please read them carefully before proceeding.

1. **Ownership and Copyright**

All photographs, designs, and creative works produced by Iris Delany Photography + Graphic Design remain the exclusive property of Iris Delany Photography + Graphic Design unless otherwise agreed upon in writing. This includes, but is not limited to, all original images, graphic designs, edits, digital files, and prints.

Clients are granted a limited, non-transferable, and non-exclusive license to use the final, delivered products for personal or business use as specified in their contract. Any commercial use, reproduction, modification, or distribution of the works is prohibited without explicit permission from Iris Delany Photography + Graphic Design.

2. **Booking and Payment**

- A 50% non-refundable deposit is required to secure any booking or service. This deposit confirms the reservation of your project date and time and will be applied toward the total cost of the service.

- The remaining balance is due upon completion of the project before the final delivery of any files or printed materials.

- If the remaining payment is not made within 7 days of completion, Iris Delany Photography + Graphic Design reserves the right to withhold the final product until payment is received.

3. **Non-Refundable Deposit**

The 50% deposit is non-refundable under any circumstances, including cancellation or rescheduling by the client. By making this deposit, you acknowledge that Iris Delany Photography + Graphic Design has reserved time and resources for your project, which could otherwise be allocated to other clients.

If Iris Delany Photography + Graphic Design is unable to perform the service due to unforeseen circumstances (such as illness, emergency, or other issues outside of the company’s control), you will be given the option to reschedule the service or receive a full refund of any payments made, including the deposit.

4. **Rescheduling and Cancellations**

- Clients may request to reschedule services no later than 7 days before the scheduled service date. Any rescheduling is subject to the availability of Iris Delany Photography + Graphic Design.

- Cancellations within 7 days of the scheduled date will result in forfeiture of the deposit. Any payments made beyond the deposit may be refunded at the discretion of Iris Delany Photography + Graphic Design.

- If a client is more than 30 minutes late to a session without prior notification, Iris Delany Photography + Graphic Design reserves the right to cancel the session, resulting in the forfeiture of the deposit.

5. **Client Responsibilities**

Clients are responsible for:

- Providing accurate and timely information required for the successful completion of the project.

- Arriving at any scheduled sessions or providing assets necessary for graphic design work on time.

- Communicating any specific expectations, creative preferences, or requirements before the start of the project.

6. **Delivery of Final Products**

- For photography services, Final, edited images will be delivered within 6-7 business days after proof selection and payment of the remaining balance.

- For graphic design services, drafts and revisions will be delivered according to the project timeline, as outlined in the project agreement.

- Final products will be delivered in the agreed-upon format (digital, print, or both). Any additional requests for changes after final delivery may incur extra fees.

7. **Revisions and Edits**

- Photography: Iris Delany Photography + Graphic Design offers up to 2 rounds of basic editing and revisions as part of the standard service. Additional edits may be charged at an hourly rate.

- Graphic Design: The project includes 2 rounds of revisions. Additional changes beyond this scope will be subject to an additional fee.

8. **Liability**

Iris Delany Photography + Graphic Design will take all reasonable steps to ensure the quality and professionalism of services. However, Iris Delany Photography + Graphic Design shall not be held liable for:

- Any loss, damage, or injury caused during a photo session or while using any final product.

- Any delays or interruptions caused by unforeseen weather, venue restrictions, or equipment failure.

9. **Force Majeure**

Iris Delany Photography + Graphic Design shall not be responsible for any delays or failure in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of natural disasters, war, government actions, labor disputes, or equipment failure.

10. **Privacy and Confidentiality**

Iris Delany Photography + Graphic Design respects your privacy and will not share your personal information or project details with any third parties without your consent, except as necessary to complete the services or as required by law.

11. **Acceptance of Terms**

By booking any service with Iris Delany Photography + Graphic Design, you acknowledge that you have read, understood, and agree to these terms and conditions. It is the client's responsibility to review these terms before booking.
